Graham: Obama Doctrine Is Gathering Intelligence Through Plea Bargaining

GRETA VAN SUSTEREN, Fox News: Let me see if I understand, there are two ways you can be an Enemy Combatant. First, you could be a foreigner captured who is at war with the Unites States. There is another category, as I understand, enemy combatant, where you are connected to a foreign group that is trying to do harm to the United States. You could be taken into custody by the military, questioned for 30 days, and then after 30 days you get sent out to the civilian system?

SEN. LINDSEY GRAHAM (R-SC): In his case, he was never eligible for trial by the military – that’s different – what I’m talking about is gathering intelligence. Two systems in play: to prosecute him for the crimes he’s committed and to collect intelligence to protect me and you against future attacks on our nation.

VAN SUSTEREN: Did he qualify for enemy combatant?

GRAHAM: We don’t know. It’s Monday. We caught him Friday. The Obama Doctrine – for four and a half years, we’ve caught Osama bin Laden’s son-in-law, he wasn’t an enemy combatant under this administration’s rules, he was the spokesman for al Qaeda after 9/11. This president has not designated anyone as an enemy combatant, what does that matter? All the information that led to the capture of Osama bin Laden came from enemy combatants held at Guantanamo Bay, interrogated over a long period of time.  What I want is pretty simple, I want to be able to talk to him without a lawyer present to gather intelligence about future attacks that may come our way. And none of the information can be used against him in his trial. I’m not worried. A first-year law student could convict this guy.
